Question Concerning the Rights of My Nephew?

Question by Haleigh: Question concerning the rights of my nephew?
I have these huge family issues. I am not trying to get custody of my nephew but I was wondering if my mother could. My sister who is 20, lives with me (18) my mother (45) and my dad (47). She had a baby a little over a year ago. She now has a very bad drug addiction and has been causing so many fights and problems. She even had CPS called on her once but they did not test her for drugs. I watched my nephew every day while my sister is at work and I am so worried for him but I don’t know what to do She’s tearing the family apart and she won’t go get help. Tonight we got in a big family argument and she left not too long ago and took my nephew with her. I was wondering if my mother ( the grandmother) had any rights when it comes to him. She wants to call the cops but we are afraid they might take him. The father of the baby is not in the picture because he is also a drug addict. She is out driving around with my nephew right after she ingested drugs and I have no idea what to do because I want to call the cops but since the father and mother are both unfit parents with they put him in foster care until my mom can get custody? My sister will not just sign over custody so we are having to fight it. So can my mother keep him since he lives with her and takes care of the child just as much if not more than the mother? PLEASE HELP!!!!
I’m talking like if I were to call the cops RIGHT now on her since she’s on drugs with the baby. What would happen to him? Could he stay here? Or would he be taken right away if she were to be arrested for a day or two? And what would happen after that?
